These Terms & Conditions ("Terms") govern your use of PawRoute, a subscription web application for managing a dog walking and pet care business (the "Service"). The Service is operated by W Rieger ("we", "us", the "Seller"). By creating an account or continuing to use the Service, you agree to these Terms. You are contracting with W Rieger.
1. The Service
PawRoute lets dog walkers and pet care providers manage their walking schedule, client and pet records, walk photos, rates, and invoices. We grant you a limited, non-exclusive, non-transferable right to use the Service within your selected plan. You must be of legal age to enter into these Terms, and if you use the Service on behalf of an organization, you confirm you have authority to bind it.
2. Your account
You must provide accurate information when registering and keep it up to date. You are responsible for keeping your account credentials confidential and for all activity that occurs under your account.
3. Acceptable use
You must not misuse the Service. In particular, you must not:
- Use the Service for any unlawful purpose, or to commit fraud or send spam.
- Infringe the intellectual property rights of others.
- Interfere with the security or operation of the Service, including introducing malware, probing or scanning for vulnerabilities, or scraping the Service.
- Reverse engineer, resell, redistribute, or circumvent technical limits of the Service.
4. Your content
You retain ownership of the content you upload (such as client records and pet photos). You grant us a limited license to host and process that content solely to provide the Service to you. You are responsible for having the right to upload the content you add, including photos of clients' pets.
5. Intellectual property
We retain all ownership of the Service and its intellectual property, including the software, documentation, and branding. Nothing in these Terms transfers any of those rights to you.
6. Payments and subscription
The Service is offered as a paid monthly subscription. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms, available at paddle.com/legal/checkout-buyer-terms. Your subscription renews monthly until cancelled; you can cancel at any time through the billing portal and will keep access until the end of the paid period.
7. Service level
We work hard to keep the Service available, but we do not guarantee uninterrupted or error-free performance. The Service is provided "as is" and we disclaim all implied warranties, including merchantability and fitness for a particular purpose, to the fullest extent permitted by law.
8. Liability
To the fullest extent permitted by law, we are not liable for indirect, consequential, or special damages (including loss of profits, data, or goodwill), and our aggregate liability is capped at the fees you paid in the 12 months before the claim. Nothing in these Terms excludes liability for fraud, death, or personal injury where the law requires it.
9. Suspension and termination
We may suspend or terminate your access for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. When your access ends, you may request an export of your data for 30 days, after which it may be deleted.
10. General
These Terms are governed by the laws of the Seller's jurisdiction, and disputes will be resolved in its courts. You may not assign these Terms without our consent; we may assign them in connection with a merger or acquisition. We are not liable for failures caused by events beyond our reasonable control. If any part of these Terms is unenforceable, the rest remains in effect.
